It’s important for building owners and property managers in New York City to inspect their properties for the presence of lead paint and get rid of it right away.

Local Law 31 went into effect in August 2020, and it requires all residential building owners, landlords, and property managers to arrange for any properties built before 1978 and known to contain lead based paint to undergo X-Ray Fluorescence lead inspections carried out by an EPA-certified inspector by August 2025.

The inspection must be performed by an Environmental Protection Agency (EPA) certified Lead paint Inspector / Risk assessor. That inspector will test all units and common areas using a device called an XRF machine, which identifies lead in paint. Qualified contractors can be found at https://www.epa.gov and search for “lead certified contractors”.

Please schedule lead inspections in NYC as necessary to avoid civil penalties. Failure to meet deadlines or requirements can result in a Class C violation and civil penalties of $1,000 minimum and $5,000 maximum per violation. If lead paint is discovered in these buildings, you will also need to invest in lead paint removal services in NYC or face Class “C” hazardous violations that can result in $250 per day fines, up to maximum of $10,000.
